PURCHASER’S CONTRACT

(Purchaser agrees to use the kennel name Cortlands as a prefix in naming the dog.)

 

1.   Cortland Labradoodles (CL) guarantees that at the time of purchase, this dog is in good health, with all vaccinations and wormings current.  CL advises a veterinary check-up upon arrival, and will refund the purchase price, or replace the dog with a puppy from the next available litter, if the dog is found unhealthy within one week of the purchase date.  This guarantee does not cover accidents or injuries.  CL must be notified and supplied with veterinary documentation of poor health, before the dog can be returned for a full refund or replacement. CL reserves the right to have our veterinarian examine the dog and verify findings before issuing a refund.  All shipping expenses will be paid for by the purchaser. 

 

2.   Purchaser agrees to neuter/spay the puppy before it reaches one year of age. Purchaser agrees to supply Seller with a veterinarian's letter by certified mail as proof of a neuter/spay. If Purchaser fails to neuter/spay this puppy and provide proof to the Seller by one year of age, rights and ownership of the dog will automatically terminate and revert back to Seller who may immediately assume possession of the dog. Seller's reasonable attorney's fees for recovery of the dog will be paid by the Purchaser.  It is understood by all parties to this agreement that this puppy of the above specified description is of pet quality.

 

3.   Hip dysplasia (HD) can develop from genetic or environmental causes.  Purchasers are hereby cautioned about the importance of diet and the risks of overfeeding, and excessive exercise too early in their development. CL will assume risk for genetic causes for the first two years with the following guarantee:  Should the dog develop HD within its first 26 months, CL will replace it with a puppy from the next available litter, or refund ˝ of the purchase price, at their discretion.    The purchaser may return or keep the defective dog, but if retained, the dog must be sterilized, if not purchased as such.  For dogs purchased as breeding stock, proof of sterilization will be required before a refund/replacement will be issued.  Proof of HD is required before a replacement/refund will be made, and can take the form of documentation from the Orthopedic Foundation for Animals (OFA).  CL reserves the right to have their Veterinarian or the OFA  confirm the results before a replacement/refund is made.   The HD guarantee expires when the dog reaches 26 months of age, unless the OFA recommends additional X-rays at 30 months of age, in which case it will be extended to 31 months of age, with appropriate documentation. The purchaser will pay for all shipping expenses. 

 

4.   Likewise CL guarantees the dog against Progressive Retinal Atrophy (PRA), and will offer replacement or a partial refund according to the same terms and procedures outlined in section 2 above, if the dog develops PRA within its first 3 years.  Proof will take the form of documentation from a canine ophthalmologist. This guarantee will expire at 38 months of age. The purchaser will pay for all shipping expenses. 

 

5.   The above guarantees (#’s 1, 2, and 3) for replacement/refunds will not be made for dogs that are no longer alive, no longer in the possession of the purchaser, or have been bred.

 

6.   The Purchaser understands that the labradoodle is not recognized by or registered with the American Kennel Club.  We will follow the registration procedures of the Labradoodle Association of Australia and record numbers with names.  All puppies bred by Cortland Labradoodles shall have names beginning with the kennel name “Cortland”, followed by a second name of the purchaser’s choice.  Because the American Kennel Club does not recognize the labradoodle as a separate breed, it is imperative that we protect bloodlines by recording pedigrees and numbers of our dogs.

 

7.   The purchaser agrees to provide good care to the dog, including proper nutrition, shelter, exercise, immunizations, veterinary care and socialization.  The Purchaser agrees not to tie the dog outside or let it roam free.  The Purchaser agrees not to overfeed the dog nor subject it to excessive exercise, especially before the age of 12 months.  The purchaser’s signature on this contract indicates his/her awareness that overfeeding and excessive exercise can result in HD.   Dogs less than two years of age should not be taken “jogging”, or on long walks of more than a mile, or exercised to the point of exhaustion. 

 

8.   CL will not be responsible for the expenses of veterinary care for the dog after the purchase date.

 

9.   In order to minimize the chances of a labradoodle ending up in a shelter or unwanted situation, CL asks to be notified if the purchaser is forced to give up the dog and cannot find a good home for it.  CL may elect to assist in placement or accept the dog back.

 

10. The puppy has been microchipped for identification.

 

Purchaser has read, understood and agreed to the terms of this agreement.  The purchaser must sign and return one copy to Cortland Labradoodles to activate the terms.
